Welcome to IberAmeri Talent (“we,” “our,” “us,” “IBAM”). These Terms of Service (“Terms”) govern your access to and use of www.iberameritalent.com and all related services, including recruitment, staffing, consulting, contractor management, and managed-talent solutions (collectively, the “Services”). By using our Services, you (“Client,” “Talent,” or “User”) agree to these Terms and our Privacy & Data Protection Policy. If you do not agree, you may not use our Services.
1. Who We Are
IberAmeri Talent connects U.S. and international companies with remote-based professionals located in Spain, Latin America, and other regions, in accordance with local and international regulations. We provide recruitment, vetting, hiring, training, and management services to help companies build high-quality global teams. Our legal entity operates under the laws of Harris County, Texas, USA, and Services may be delivered through local affiliates, partners, or contractors.
2. Scope of Services
- Recruitment and sourcing of qualified professionals (“Talent”)
- Vetting, interviewing, and background/reference checks
- Placement of permanent or contract professionals
- Managed-staffing and remote-team programs
- Advisory, coaching, and HR process optimization
We may modify, suspend, or discontinue any Service at any time, with or without notice.
3. Eligibility
You must be 18+ and have authority to accept these Terms. If you act for a company, you confirm you can bind the company.
4. Client Responsibilities
- Provide accurate roles and requirements; respond promptly and professionally
- Treat all professionals fairly and without discrimination
- Comply with applicable labor and contractor laws and act in good faith
Clients make final engagement decisions and ensure compliance with local and international legal requirements. When using IBAM’s Managed Talent program, payments and compliance are administered in line with U.S. and foreign contractor regulations.
5. Talent Responsibilities
- Provide truthful, complete information and keep it current
- Maintain confidentiality of opportunities
- Comply with local legal, tax, and professional standards; act in good faith
IBAM may suspend or remove profiles at its discretion.
6. Fees & Payment Terms
Fees and payment details are to be specified in written Terms and Conditions Agreements with Clients and Talent.
7. Relationship
IBAM acts as a facilitator and managed-services intermediary between Clients and professionals. Contracts, payment arrangements, and working conditions are administered in accordance with U.S. and foreign contractor laws and may vary by location and scope.
8. Intellectual Property
All website content, trademarks, branding, and materials are owned by IberAmeri Talent or its licensors. Do not copy, modify, or reuse without written consent.
9. Confidentiality
Clients and professionals must keep all shared information (resumes, compensation data, strategies, client data, etc.) confidential and use it only for recruitment or engagement purposes. Third-party disclosure requires written consent, except as required by law.
10. Privacy & Data Protection
We take privacy seriously. Our full policy is below and incorporated by reference.
11. International Operations
We operate across jurisdictions. Cross-border hiring may involve compliance with foreign laws, currency exchange, and taxes. IBAM makes reasonable efforts to ensure compliance; Clients remain responsible for their own legal and tax obligations.
12. Prohibited Uses
- Illegal/fraudulent use
- Impersonation or misrepresentation
- Uploading harmful, offensive, or misleading content
- Attempting to access, damage, or disrupt IBAM systems or data
13. Mutual Limitation of Liability
Except as prohibited by law: (a) Neither Party is liable for lost profits, business/goodwill, loss of use/operations, or any indirect, special, punitive, or consequential damages. (b) Each Party’s total aggregate liability is limited to 150% of the total fees paid or payable by the Client to IBAM in the preceding 12 months before the event giving rise to the claim.
14. Indemnification
Clients and professionals agree to indemnify and hold harmless IberAmeri Talent, its affiliates, officers, and employees from claims arising from misuse of Services, breach of these Terms, or violations of law.
15. Termination
IBAM may suspend/terminate Services for breach, misuse, or non-payment. All accrued payment obligations remain enforceable.
16. Dispute Resolution & Governing Law
These Terms are governed by the laws of Harris County, Texas, USA. Parties will first attempt good-faith negotiation. If unresolved, claims may be brought in the state or federal courts of Harris County, Texas. For international Clients, ICC arbitration may be mutually agreed.
17. Changes to Terms
We may update these Terms; the latest version will be posted with a new “Last Updated” date. Continued use = acceptance.
18. Non-Discrimination & Equal Opportunity
We prohibit discrimination based on age, race, color, ethnicity, national origin, gender, sexual orientation, gender identity, marital status, disability, religion, political belief, citizenship, or geography. Remote professionals will not be disadvantaged due to work location. Clients must uphold the same standards.

Privacy & Data Protection Policy

This policy explains how we collect, use, store, and protect personal data in compliance with EU GDPR, U.S. privacy laws, and international standards. It is incorporated into the Terms above.

2. How We Use Personal Data
- Match professionals with client opportunities
- Communicate through the hiring process
- Conduct vetting and due diligence (as authorized)
- Administer managed-talent and contractor relationships
- Process payments and ensure compliance
- Improve Services and website experience
We do not sell or rent personal information.
3. Legal Basis for Processing
- Consent (e.g., application or contact form)
- Contractual necessity (to deliver Services)
- Legitimate interest (recruiting/business communications)
- Legal obligation (compliance, taxes, reporting)
4. Data Retention
We retain data only as long as needed for business/legal purposes. Candidate profiles may be stored up to 24 months for future roles unless deletion is requested.
5. Data Sharing & International Transfers
We may share limited data with authorized providers (e.g., payroll, compliance, background checks), affiliates/contractors under IBAM supervision, and authorities when legally required. Cross-border transfers (U.S., Spain, LATAM, etc.) use recognized safeguards (e.g., EU Standard Contractual Clauses).
6. Data Security
We use administrative, technical, and physical safeguards (encryption, secure storage, role-based access) to protect data.
7. Your Rights
Depending on jurisdiction, you may access, correct, delete, restrict/object to processing, or request portability. Contact: info@iberameritalent.com. We aim to respond as soon as possible.
8. Cookies & Analytics
We may use cookies/analytics to enhance experience and measure performance. You can disable cookies via browser settings. Cookies do not store sensitive data.
9. Confidentiality
All IBAM staff, contractors, and partners are bound by confidentiality agreements. Information is used solely for recruitment, vetting, and service delivery.
